“If a general contractor is performing work on existing residential properties, a Basic Business License is not required for the Home Improvement Contractor category.” A general contractor with a Basic Business License for the general contractor category who performs work on the residential property does not need a Basic Business License for the DIY category if the general contractor meets 3 additional requirements for a DIY contractor`s license. [35] These include requirements for DIY contracts, model contracts, and receipt forms for authorization and non-acceptance of payments by an owner until a receipt is paid to the owner, as explained in the previous paragraph. The license must be in effect at all relevant times. [46] No performance can be made in anticipation of a licence and the courts have decided that a licence acquired after the acquisition will not be recognised. At Cevern, Inc. Ferbish, 666 A.2d 17, (D.C. 1995), the contractor had applied for and approved a licence before entering into a contract with the owner and accepting its first payment. However, the royalties for the licence were not paid by the contractor until after the first advancement payment. The Court found that the anticipation of a licence was legally insufficient and that the contract was unenforceable and unenforceable. As a result, the contractor was unable to enforce his mechanic`s instructions.
